These Terms of Service ("Terms") are an agreement between you and Shopmate ("Shopmate", "we", "us"), covering the Shopmate mobile app, the shopmategrocery.com website, and any related services (together, the "Service"). By creating an account, continuing as a guest, or otherwise using the Service, you accept these Terms. If you do not accept them, do not use the Service.

Shopmate lets you capture grocery receipts, extract the line items from them automatically, keep a purchase and spending history, search products, compare prices across nearby stores, build grocery lists, and receive price-drop alerts. Prices shown in the Service come from receipts contributed by users and from publicly available retailer sources.
You must be at least 16 years old to use the Service. By using it you confirm you meet that requirement and that you have the legal capacity to enter into these Terms.

"Your Content" means anything you provide to or generate through the Service. In practice this includes:
The Privacy Policy describes how this information is handled as personal information and what choices you have.
You keep ownership of Your Content. You grant Shopmate a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, process, analyse, adapt, combine with other data, create derivative works from, and otherwise use Your Content, for the purposes set out in clause 5.3.
This licence ends when you delete your account, except for aggregated and de-identified data already derived from Your Content, which we may continue to use indefinitely as described in clause 6. We do not claim a perpetual licence over your receipts, your images, or any data that identifies you.
You warrant that you have the right to grant this licence for everything you submit, and that Your Content does not infringe anyone else's rights.
We use Your Content to:
Data we share with third parties under clause 5.3 is aggregated or de-identified before it leaves us. You accept that de-identified data derived from Your Content is no longer your personal information and that we may retain and use it indefinitely.
You can delete your account at any time from Account → Delete account in the app, or by emailing tom@shopmategrocery.com. Deleting your account permanently removes your receipt images, your receipt records, your grocery lists, your profile and preferences, and your login.
The price and purchase rows derived from your receipts, and the record of the searches you ran, are retained in de-identified form — detached from your account and identity — so that the shared price catalog and the derived datasets described in clause 5.3 remain accurate and complete. This is a condition of using the Service free of charge.
Prices in the Service come from user-contributed receipts and from public retailer sources, and are historical observations rather than live shelf prices. They may be out of date, misread by automated extraction, entered incorrectly, or specific to a store, member status, or promotion that does not apply to you. We do not guarantee that any price, product match, per-unit calculation, saving, or availability shown is accurate or current. Always check the price in store before you buy. Any purchasing decision you make on the basis of the Service is yours. Prices are shown in Australian dollars and, where the retailer prints them that way, include GST.
Shopmate is independent. Store names, chain names, brands, logos, and trade marks shown in the Service belong to their owners and are used to identify products and stores only. Shopmate is not affiliated with, endorsed by, or sponsored by any retailer or brand, and no such relationship should be inferred.
The Service depends on third-party providers, including Supabase (database, authentication, and image storage), Google (Gemini for receipt extraction, Places for store lookup, and Google Sign-In), Sentry (crash diagnostics), and the Apple App Store and Google Play. Your use of the Service may be subject to their terms, and their availability is outside our control.
The Service, including its software, design, product catalog, price database, matching logic, and branding, is owned by Shopmate and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own household grocery shopping. All other rights are reserved.
The Service is provided on an "as is" and "as available" basis. Shopmate is under active development; features may change, be limited, or be withdrawn, and the Service may be unavailable at times. We may impose usage limits (for example, on the number of receipts that can be scanned without an account) and may introduce paid features in future.
We may suspend or terminate your access if you breach these Terms, if you submit fraudulent receipts or prices, or if we reasonably need to in order to protect the Service or other users. Unless the breach is serious or we are required to act immediately, we will give you notice and a reasonable chance to fix the problem first, and you can export or delete your data before losing access. You may stop using the Service at any time. Clauses 5.2, 5.4, 6, 7, 10, 13, 14, 15, and 17 survive termination.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, and nothing in these Terms should be read as suggesting otherwise.
Shopmate is a service of a kind ordinarily acquired for personal, domestic, or household use, so we do not attempt to limit our liability for failures to comply with the consumer guarantees to resupply of the service.
Subject to the paragraphs above, and to the extent permitted by law, we exclude other warranties and representations not expressly set out in these Terms, including any that the Service will be uninterrupted, error-free, or fit for a particular purpose.
Clause 13 prevails over this clause. Subject to clause 13, and to the extent permitted by law, Shopmate is not liable for indirect, incidental, special, or consequential loss, or for loss of profit, savings, data, or goodwill, arising out of or in connection with the Service, and our total aggregate liability is limited to AUD $100. This limit does not apply to liability under the consumer guarantees, to liability arising from our fraud or wilful misconduct, or to any liability that cannot lawfully be limited.
You indemnify Shopmate against any claim, loss, or cost we reasonably incur arising from your breach of these Terms, your submission of content you had no right to submit, or your unlawful use of the Service. This indemnity is reduced to the extent our own acts or omissions caused or contributed to the loss, and does not apply to loss you could not reasonably have avoided.
We may update these Terms. If the changes are material — in particular any change to how your data is used or shared under clause 5 — we will update the effective date above and give you reasonable advance notice in the app before they take effect. Continuing to use the Service after that means you accept the updated Terms. If you do not accept them you can stop using the Service and delete your account, and clause 6 applies to your data as it stood at that time.
These Terms are governed by the laws of Western Australia, Australia. You and Shopmate submit to the non-exclusive jurisdiction of the courts of that State and the courts able to hear appeals from them.
